TERMS & CONDITIONS

1.      Organizer Information:

1.1. The Organizer of the Service is:

MBC FZ-LLC, a limited liability company located in Dubai Media City, Building 3, Dubai, United Arab Emirates (hereinafter referred to as the “Organizer” or “MBC”).

1.2. The Service:

FlashWIN PREMIUM (hereinafter referred to as “FlashWIN PREMIUM” or the “Service”) is a web game service carried out by MBC that gives participants the chance to win prizes by answering trivia questions. Flash10 is a game mode available on FlashWIN PREMIUM.

2.      Time Frame of the Service:

2.1. The Service started March 2025 and will continue until the Organizer communicates the end date on flashwin-premium.mbc.net.

2.2. The Organizer reserves the right to amend the Service or these Terms and Conditions without prior notice.

3.      Participants of the Service:

3.1. The following are eligible to participate:

3.1.1.      Natural persons (other than people employed by the Organizer, or its partners, for the period of the competition, and also their relatives up to 4th degree and spouses).

The participant/winner shall be deemed the owner of the phone number under which the participation/winning entry was registered. For the purposes of the Service, the "owner" of a phone number is defined as the individual or entity whose name appears on the mobile service provider’s account records for the phone number in question.

If the participant is not the registered owner of the phone number, the winner will be required to provide a valid Power of Attorney (POA) or other legal authorization from the registered owner, granting the participant authority to claim the prize.

The Organizer reserves the right to request additional documentation or information, including but not limited to proof of identity, to verify the authenticity of the winner’s claim and eligibility. Failure to provide the requested information within the timeframe specified by the Organizer may result in disqualification and forfeiture of the prize.

3.1.2. In case a participant subscribed​ to the Service using a corporate-owned mobile number, only an authorized signatory on behalf of the legal entity will be entitled to take receipt of the prize.

3.2.Participants must be at least 18 years of age, or the age of majority in their state, province, territory or country, to participate in the Contest. In the event the Special terms and conditions of a Contest allows for the participation of minors, then such minors may only participate under the supervision of an adult. Minors can only participate in the contest if their parent or legal guardian signs a release or related document. Participants under the age of majority must obtain their parent's or guardian's consent and provide us with proof if requested. The parent or guardian must act on behalf of the minor for all contest-related activities that the minor cannot do. Otherwise, Organizer may exclude the minor from the contest or withhold their prize if the parent or guardian withdraws representation.

3.3. The Organizer reserves the right to disqualify any participant (either as unique mobile number or as natural person / legal entity) if it has reasonable grounds to believe the participant has breached any provision of the Terms and Conditions.

3.4. By participating in the Service, participants hereby warrant that all information submitted is true, current, and complete.

3.5. Each trial/token given for a specific game mode can be redeemed for a single game of that game mode only, and must be acquired by a purchase or rewarded upon the successful renewal of subscription in the Service, and the Organizer reserves the right to disqualify any participant (either as unique mobile number or as natural person / legal entity) if it has reasonable grounds to believe the participant has acquired tokens or played more games than he/she is eligible for following the terms and conditions of the Service.

4.      Subscription Information:

4.1. Participants may subscribe to the FlashWIN PREMIUM web games by visiting flashwin-premium.mbc.net, selecting their operator, entering and verifying their mobile number, and clicking “Subscribe Now” or “Start.”

4.2. Available Operator short-codes:

4.3. Upon subscription, participants are entitled to 2 trials for Flash10 and will earn points for prizes and access daily game details available at flashwin-premium.mbc.net/.

4.4. The trials from the daily subscription expire after one (1) calendar day (from the date and time of successful charge) if not used.

5.      Extra Trial Bundles

5.1. Each participant can buy additional trials for Flash10 by visiting the home page of the website flashwin-premium.mbc.net/ and clicking the button (Buy Now). The cost of extra bundles is as follows:

5.2. The trials from the extra bundles expire after seven (7) calendar days (from the date and time of purchase) if they are not used.

5.3. Each operator has specific rules and limits that apply to the extra trial bundles, and for some operators, extra trial bundles may not be available.

5.4. Each participant has the opportunity to play the trials of Flash10 per calendar day by using his/her available trials under his/her account details.

 6.      Acceptance of Terms of Use:

6.1. All participants warrant that they have read and fully understand these Terms and Conditions which are available at flashwin-premium.mbc.net.

6.2. By registering and subscribing to the Service, the participants confirm their complete acceptance and full understanding of these Terms and Conditions and agree:

6.2.1.      To receive communication via SMS or/and web or/and application notification from the Organizer on their mobile phones relating to the FlashWIN PREMIUM web game.

6.2.2.      To receive communication/advertising via SMS or/and web or/and application notification offers from the Organizer or from other companies that cooperate with the Organizer.

6.3. The Organizer reserves the right to cancel or amend the offer and these Terms and Conditions at any time and without prior notice. Any changes will be posted online on flashwin-premium.mbc.net/.

6.4. In the event of dispute regarding the Terms and Conditions, conduct, results, and all other matters relating to the FlashWIN PREMIUM web game, the decision of the Organizer shall be final and no correspondence or discussion shall be entered into.

6.5. These Terms and Conditions will remain in full force and effect while the Organizer provides the Service (not taking into account temporary suspensions of the Service for operational reasons, e.g. for repairs, planned maintenance or upgrades).

7.      Availability, unsubscribe and Opt-Out:

7.1. All information relating to the FlashWIN PREMIUM web game can be found at flashwin-premium.mbc.net/.

7.2. Information about the number of points (participations/points) during the Service is posted on the website flashwin-premium.mbc.net/, and participants can check such information upon successfully logging-in.

7.3. The participant agrees to receive SMS messages, promotional offers and any other contests launched by the Organizer on their mobile phone.

7.4. The participant also agrees to receive alerts from the Organizer via SMS, advertising offers, and any other campaigns of the Organizer on his/her mobile phone.

7.5. All promotional messages related to the FlashWin PREMIUM sent to participants are free of charge.

7.6. Participants who wish to opt out should:

-        Inform the operator as per the operator’s terms and conditions of opting out; and

-        Contact the Organizer at care@mbc.net.

7.7. Each participant will be able to unsubscribe from the Service and stop receiving any information about the Service. The unsubscription process will vary based on the participant’s carrier/operator. It will be clearly communicated to the participant upon his/her subscription. The participant will be able to unsubscribe either by clicking on an unsubscription link sent via SMS or by sending an SMS with the unsubscription keyword provided upon subscription. Specifically, unsubscription will be to the SMS short-code listed in Table 1 below.

7.8. The points do not reset upon opt-out and can be activated if a participant re-subscribes. After opt-out a participant might receive updates from the Service on new prizes/offers.

7.9. If after the participant chooses to send again an opt-in keyword to the short code, he/she will be again considered as subscribed in the Service and his/her points will be retained.

7.10. If the Service is terminated, the Organizer of the Service will publish in the official resources of FlashWIN PREMIUM (http://www.flashwin-premium.mbc.net) a message about the termination of the Service.

7.11. During the Service, the Organizer reserves the right to add or terminate the SMS short code in Table 1 or web game participation. If the latter one happens, all the participants who have participated during the Service still reserve their points for the prizes.

7.12. Interruption or early termination of the Service shall not release the Organizer from its obligation to give out already awarded prizes and execute other actions required, except for the cases when termination or interruption of the Service was called by actions or events which are not under the Organizer’s control.

7.13. The Organizer of the FlashWIN PREMIUM web game uses participants' personal information in accordance with its privacy policy which can be viewed at the following link: https://www.mbc.net/privacy-policy. The Operator's privacy policy will also apply

7.14. The Organizer reserves the right not to enter into written negotiations or otherwise contact with the participants of FlashWIN PREMIUM web game other than in accordance with the Terms and Conditions or in accordance with the requirements of the current legislation of U.A.E.

7.15. Invalid Subscriptions: The Organizer reserves the right to reject any entries that are inaudible, incomplete, incomprehensible, damaged or otherwise improper. The Organizer also reserves the right to refuse submissions that are unlawful, indecent, racist, inflammatory, defamatory, or that it believes would otherwise impair its reputation and goodwill. The Organizer accepts no responsibility for any late, lost or mis-sent subscriptions, including but not limited to text messages, calls or emails that are not received due to technical defects, network congestion or any other reason. Proof of sending any postal subscription is not considered proof of the Organizer’s receipt of it.

7.16. Automated Entry: The use of any automatic entry software or any other mechanical or electrical means that allows any participant to repeatedly enter any contest is prohibited.

8.      Game Rules and Prizes:

8.1 Instant Prizes:

8.1.1.      Participants who answer all 10 questions correctly in a game are eligible to win an instant prize ranging from $1,000 to $7,000 cash, depending on the promotional period.

8.1.2.      Within the same day, up to three (3) participants can win instantly, afterwards the game is locked until the next calendar day.

8.1.3.      Winners of the instant prize are eligible to win the Leaderboard Prize or any other extra prize.

8.1.4.      Any participant can win an instant prize unlimited times.

8.2. Participants earn points based on their activities and leaderboard rankings.

8.3. Leaderboard-Based Prizes:

8.3.1.      Each month, participants at the top of the leaderboard will be awarded prizes based on their accumulated points. The number of winners may vary depending on the time of year or special occasions.

8.3.2.      Leaderboard Tiebreaker

In the event of a tie between two or more participants on the leaderboard, the winner will be determined based on their overall percentage of correct answers throughout their participation in the game. For example, if Participant A has an overall correctness percentage of 45%, and Participant B has an overall correctness percentage of 30%, Participant A will be declared the winner. This tiebreaker ensures a fair evaluation of performance.

8.3.3.      Leaderboard Prizes and Duration

The leaderboard prizes and duration of the competition may vary and will be determined at the sole discretion of the Organizer. The leaderboard prizes will be awarded to the top Χ (10) participants based on their accumulated points over a defined time period.

The Organizer reserves the right to amend the prizes and their distribution at its sole discretion. Participants are encouraged to review the latest version of the Terms and Conditions which are available at flashwin-premium.mbc.net/ for updates.

8.4. Extra prizes:

8.4.1.      During the aforementioned period, the Organizer may also announce extra prizes to be awarded to Service participants through draws.

8.4.2.      Eligible for those prizes will be all the participants who are active during the corresponding time period and have sufficient points to enter the draw.

8.4.3.      Each eligible participant can win one extra prize only within the same calendar year and is eligible for winning any other prizes which are not ‘extra prizes’.

8.4.4.   A special draw will be conducted on 31/07/2025 midnight (00:00 KSA time on 01/08/2025), where the prize will be one car, with a retail value of $20,000.  The exact make and model of the car will be determined at the sole discretion of the Organizer.

To be eligible to participate in the draw, users must satisfy both of the following conditions:

    - Users must have completed at least one billed transaction from 01/05/2025 00:00:01 to the scheduled draw date 31/07/2025 23:59:59.
   - Users must have maintained an active paid subscription for a minimum of one full day from 01/05/2025 00:00:01 to the scheduled draw date 31/07/2025 23:59:59.

Users who are on a free trial day or benefiting from complimentary access at the time of the draw will not be eligible for this prize.

8.5. Mystery Box:

8.5.1.      Before playing the trial, the participant will enter the "Mystery Box" phase allowing participants to choose a bonus prize/booster/trial by selecting one box from the screen, the bonus doesn't replace the instant prize or any of the prizes, the bonus is an extra interactive element for participants that gives them extra benefit.

8.5.2.      The Mystery Box may reward the participant with extra trials for the games, extra points for the leaderboard/draws or any other monetary or gadget prize type.

8.5.3.      Each eligible participant can win one ‘Mystery Box’ prize only within the same specified period and is eligible for winning any other prizes which are not ‘Mystery Box’ prizes.

8.5.4.      Prize Table:

9.      Prize Terms:

9.1. Winners will be contacted by the Organizer via their registered mobile number. To claim a prize, winners must provide identification documents and confirm in writing that they are the legal holder of the winning mobile subscriber number and entitled to the prize. Winners must also complete all necessary documents provided by the Organizer. Prizes may be collected by a representative through proxy, provided the winner submits written authorization.

9.2. Winners will be notified through a phone call, exclusively from the approved phone numbers of the MBC Group (0097143919999) or (00971562269897). Please be cautious and do not share any personal information or private data except via the official email for MBC Group, which is Winners@mbc.net. MBC is not responsible for anyone impersonating them. The participant is solely responsible for verifying the identity of the message sender and confirming their authenticity, without any civil or criminal liability on the Organizer in case of impersonation by any individual claiming to represent the Organizer or any of its affiliates.

9.3. Prizes must be claimed within six (6) months, or the winner forfeits their right to the prize.

9.4. The Organizer reserves the right to replace tangible prizes with their cash equivalent or alternative prizes of similar value.

9.5. Unless it is an instant prize, a participant cannot win the same type of prize more than once during the same promotional period.

9.6. The winner is responsible for the payment of any taxes or fees required under applicable legislation. For tangible prizes, any additional costs, such as shipping or registration fees, will be borne solely by the winner.

9.7. By participating in “FlashWIN Premium,” winners agree that their personal data, including names, surnames, photos, and video images, may be used for advertising purposes by the Organizer without prior consent and without any obligation to pay charges or royalties

9.8. The Organizer reserves the right to disqualify any winner if, at any stage of the prize awarding process, the winner fails to provide the requested information or documentation.

9.9. Decisions made by the Organizer are final and binding, and no correspondence or appeals will be entertained. Prizes are non-transferable.

9.10. If the announced prize is tangible (e.g., a car or other items in kind), the Organizer reserves the sole right to decide whether to deliver the prize in kind or provide its cash equivalent based on the market value of the prize. The winner does not have the right to dispute the Organizer’s decision regarding the form or value of the prize. By accepting these terms, the winner acknowledges and waives any legal claims to challenge the Organizer’s decision on the matter.

9.11. If the prize is sent to the winner and they fail to receive it for any reason within a period of three (3) months, the winner will be given one additional opportunity for the prize to be re-sent. If the winner is unable to receive the prize within a second period of three (3) months, their right to the prize will be canceled and forfeited.

9.12. In cases where a cash prize must be sent via bank or wire transfer, the winner shall bear all associated expenses, fees, or costs. These costs will be deducted from the prize value, particularly if a re-transfer is required due to incomplete or incorrect data provided by the winner.

9.13. The Organizer reserves the right to cancel a prize for any winner within a maximum period of three (3) months from the date of winning if the Organizer is unable to contact the winner or if the winner fails to provide the required information to claim the prize.

The prize will be provided within a period of 180 days from the date the winner is announced, and after receiving all correct winner data and ensuring that the winner has fulfilled and applied all Flashwin Premium terms and conditions. 10.  Fair Play and Anti-Cheating:

10.1. Participants must use their individual knowledge and skills. Any use of automated tools or systems to manipulate game results is prohibited. This includes, but is not limited to, the use of computerized logic, automated response generators, or any methods that interfere with the intended fair play of FlashWIN PREMIUM.

10.2. Upon any credible suspicion of cheating or manipulation of the game, or any other breach of the Terms and Conditions (as determined at the sole discretion of the Organizer), the Organizer reserves the right to immediately disqualify the participant. Disqualified participants will be ineligible to receive any prizes or rewards and may also be barred from future participation in any related services or competitions.

10.3. The Organizer reserves the right to conduct investigations into any suspected violations of these rules or the Terms and Conditions. Upon initiating an investigation, the Organizer will immediately notify the affected participant. During the investigation, the Organizer may (i) suspend the participant's account and/or (ii) withhold delivery of any prizes or rewards. Participants under investigation who are not suspended may continue to participate in the game; however, they will not be eligible to win any prizes or rewards until the investigation is complete and they are cleared of wrongdoing.

10.4. Bot/Automation Tool:

10.4.1.   Bot/automation tool means any automated software, script, or program designed to interact with the platform without direct human involvement. This includes tools that automate actions such as account creation, gameplay, tipping, or data harvesting.

10.5. Prohibited Activities Involving Bots:

10.5.1.   Participants are strictly prohibited from using or deploying any bots, automation software, scripts, or services that automate gameplay, account management, or tipping.

10.5.2.   Participants may not use bots or automation to harvest data, manipulate platform operations, generate fake interactions, or bypass platform security.

10.5.3.   Automating actions to gain an unfair advantage (e.g., leveling up in games, auto-tipping, auto-reward collection) is strictly forbidden.

10.5.4.   Participants may not automate any actions that disrupt the experience of other participants or compromise platform integrity.

10.6. Anti-Bot Detection and Monitoring: The Organizer reserves the right to implement anti-bot detection measures, including but not limited to:

10.6.1.   Captchas or other human verification methods.

10.6.2.   Automated and manual reviews of participant interactions and activity patterns.

10.6.3.   Investigation of abnormal or repetitive behavior in gameplay, tipping, or other interactions.

10.7. Account Suspension and Termination for Bot Use:

10.7.1.   Any detection of bot use or automation tools will result in immediate suspension and/or termination of the participant’s account.

10.7.2.   The Organizer reserves the right to investigate, temporarily restrict, or permanently ban any participant suspected of bot usage.

10.7.3.   Severe or repeated violations may result in the forfeiture of any earned rewards, tips, or in-game assets associated with the account.

10.8. Security and Exploit Prevention:

10.8.1.   Participants are prohibited from using bots or automation tools that compromise platform security or exploit vulnerabilities (e.g., bypassing gameplay restrictions or tipping limits).

10.8.2.   Attempts to hack, exploit, or introduce malicious bots will be treated as severe violations and may result in legal action in addition to account termination.

10.9. Reporting Bot-Related Violations:

10.9.1.   Participants are encouraged to report suspected bot-related violations through the platform’s reporting system.

10.9.2.   The platform will investigate such reports and take appropriate actions, including account restrictions or bans.

10.10. Liability for Bot-Related Actions:

10.10.1.          Participants are liable for any damage, loss, or harm caused to the platform or other participants as a result of unauthorized bot usage.

10.10.2.          The platform may pursue compensation for any losses caused by bot-related exploitations, fraud, or disruptions.

10.11. Decisions made under this provision are final, and no correspondence or appeal will be accepted by the Organizer.

10.12. Retrospective:

Upon discovering that any Participant or Winner has breached any of the Terms and Conditions of the competition and upon discovering that any person has breached any of the entry restrictions set out in provisions 10.1 through 10.10, the Organizer may exercise their right to revoke that person's eligibility and require that person to reinstate or reimburse any prize even if the prize was actually awarded and/or presented to the participant or winner in question.

11.  Additional Terms & Conditions:

11.1. In the event that the winner of any tangible prize is a non-resident of Saudi Arabia, the United Arab Emirates, Kuwait, Bahrain, Oman, or Qatar, the winner may delegate another person residing in one of these countries to receive and register the prize on their behalf. In certain cases, additional documents and a notarized power of attorney (POA) might be required to receive the prize.

11.1.1.   These conditions do not apply to cash prizes.

11.1.2.   The Organizer shall not bear any legal or other responsibility regarding any power of attorney issued by the winner to a third party.

11.2. Prizes won by minors can only be collected by their legal guardians, who must provide proof of guardianship.

11.3. If a winner is unable to collect the prize or delegate someone else to collect it within six (6) months from the date of winning, the prize will be considered forfeited. The Organizer reserves the right to award the prize to another participant at its discretion.

11.4. Winners must provide valid identification documents (e.g., ID card or passport) and proof of ownership of the winning mobile number (e.g., a contract or bill) to claim their prize.

11.5. Prizes may be collected by a representative of the winner through a duly certified authorization letter issued by the winner under applicable legislation. The authorized representative must present a valid passport at the time of collection.

11.6. The winner is responsible for paying any applicable taxes or fees associated with the prize under relevant laws. This includes any shipping, registration, or related costs for tangible prizes.

11.7. If a winner fails to collect the prize within the specified time period, the Organizer will be released from any obligation to provide the prize. The winner forfeits all rights to claim the prize or seek compensation.

11.8. Upon the collection of the prize, the Organizer is considered to have fulfilled all obligations toward the winner. By accepting the prize, the winner unequivocally and irrevocably releases the Organizer, its affiliates, officers, employees, and managers from any and all claims, causes of action, or liabilities arising from or related to the collection of the prize.

11.9. The winner shall bear sole responsibility for the immediate payment of any taxes applicable to the prize under relevant laws, including taxes related to cash or tangible prizes.

12.  Vacation Prizes

12.1. Due to the complexity of vacation prizes, specific terms apply. These terms are detailed in this clause and extend to the winner and, if applicable, their travel companion.

12.2. Vacation prizes are not awarded to individuals under the age of 18 without written consent from their parent or legal guardian, unless the parent or legal guardian accompanies the winner.

12.3. The winner and their travel companion are solely responsible for obtaining all necessary insurance (e.g., health, travel) at their own expense unless otherwise stated. All additional disbursements and costs not explicitly included in the vacation prize, such as insurance, are the winner’s responsibility. Vacation prizes typically include only airfare and accommodation unless otherwise specified.

12.4. Airport departure taxes and government taxes are not included in the vacation prize and must be paid by the winner or their travel companion.

12.5. The winner and their travel companion must hold valid passports with the necessary visas. Passports must be valid for at least six (6) months after the intended travel date. The Organizer is not responsible for ensuring the winner’s or their companion’s ability to travel or for any costs incurred if entry is denied by the relevant authorities.

12.6. It is the winner’s and their travel companion’s responsibility to be aware of and evaluate any travel warnings issued by their government regarding the destination. The Organizer is not liable for any losses or harm resulting from failure to heed such warnings.

12.7. The winner and their travel companion are responsible for obtaining vaccinations and adhering to health regulations required for the destination.

12.8. The Organizer is not responsible for providing an alternative prize, reimbursement, or any compensation if the winner or their travel companion is unable to travel due to official travel warnings, restrictions, or other unforeseen circumstances.

12.9. Winners and their companions must comply with the terms and conditions set by airlines, passport issuers, and venues, including any insurance policies related to the trip. Health, safety, and legal regulations must be strictly followed.

12.10. Vacation prizes must be claimed within six (6) months of the contest’s closing date or any specified alternative deadline. Unclaimed prizes will be invalidated.

13.  Event Prizes

13.1. If a contest prize includes attendance at an event, the Organizer is not liable if the event is canceled, changed, or rescheduled. The Organizer has no obligation to exchange the prize or provide compensation if the winner and/or their guests cannot attend.

13.2. Participants whose participation includes physical challenges must disclose any medical conditions and may be required to:

13.2.1.   (A) Undergo a medical examination approved by the Organizer and provide a health certificate.

13.2.2.   (B) Sign a waiver releasing the Organizer from liability related to participation or receipt of the prize.

13.3. Prizes involving “Meet and Greet” sessions with celebrities are subject to the celebrity’s availability and terms. The Organizer is not responsible for cancellations or missed sessions and will not provide alternative prizes or compensation.

14.  Photographs and Videos

14.1. If participation requires submitting a photograph or video:

14.1.1.   Participants affirm they own the rights to the photo or have obtained consent from all individuals appearing in it.

14.1.2.   The Organizer may use the photo worldwide for any purpose, modify it, and publish it without restrictions.

14.1.3.   Participants waive any legal claims or rights to prevent or limit the Organizer’s use of the photo.

15.  Copyrights

By participating, participants waive all rights to the content they submit and affirm that it does not infringe on third-party intellectual property.

16.  Manipulation and Other Issues

The Organizer reserves the right to cancel, suspend, or modify contests if unforeseen issues, such as fraud or technical malfunctions, compromise their integrity

17.  Service Termination

17.1. The Organizer may terminate or modify the Service at any time without liability.

17.2. Force majeure or extraordinary circumstances beyond the Organizer’s control (e.g., regulatory changes, government orders) may result in suspension or termination of contests without liability or obligation to award prizes.

18.  Final Decisions

The Organizer’s decisions regarding contests and prizes are final and binding.

19.  Exclusion of Liability

To the maximum extent permitted by law, the Organizer excludes all liability related to contests, prizes, and participant activities except in cases of gross negligence or personal injury.

20.  Limitation of Liability

20.1. The Organizer accepts no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or communications line failure when it is beyond the Organizer’s direct control.

20.2. The Organizer reserves the right to temporarily suspend the competition when deemed necessary for operational reasons (e.g., repairs, planned maintenance, or upgrades). The Organizer will endeavor to restore the competition as soon as possible following any temporary suspension.

20.3. Participants are advised to exercise caution and common sense while participating in the competition at all times.

20.4. The Organizer is not liable for technical issues, delays, or damages arising from participation in the game or acceptance of prizes.

21.  Disclaimer of Warranties
